About these terms

These terms apply when you use Banxta: this website and the check. Banxta (“we”, “us”) is run by a private individual resident in Spain. By using Banxta you agree to these terms. If you do not agree, please do not use it.

Banxta is meant for businesses and the people who act for them.

What Banxta does

You answer seven questions about your company. Banxta compares your answers with the policies that business account providers publish, such as banks and electronic money institutions. It shows you which providers’ published rules exclude a company like yours and, for the others, whether you meet every published requirement, what is left to confirm, or that the provider publishes nothing about your business activity. Each fact carries the date we last checked it and its source.

Your result is worked out automatically. Nobody reviews your answers by hand.

What Banxta is not

• It is not financial, legal or tax advice, and it is not a recommendation that any provider is right for you.
• It is not an introduction, a promotion or an application. We do not send your answers to any provider, and we do not apply for anything on your behalf.
• We do not open accounts, hold money or provide payment services.
• Each provider decides on your application by its own rules, and may ask for more than Banxta does. A result is not a prediction or a guarantee that a provider will or will not accept you.

Price

Banxta is free during the pilot. We do not ask you for payment or for payment details. If we ever charge for something, we will say so, and what it costs, before you pay, and no charge will apply to anything you did while Banxta was free.

How accurate the information is

We build results from providers’ own published policies and from regulators’ public registers. Providers change their policies, sometimes without notice, and a published policy does not always show how a provider decides in practice. Some of our sources are weaker than others, and we show a weaker source as a condition to confirm rather than as a rule. We can also make mistakes.

So before you rely on a result, confirm the points that matter with the provider, in writing where you can. If the date on a fact is older than 90 days, check it again before you apply.

Your result link

The address of your result contains your answers. Anyone who has the link can see them and open the same result, so you decide who sees them by deciding who you share it with. Our Privacy Policy explains how this works.

Fair use

Please use Banxta fairly. Do not:

• use it to give a provider false or misleading information;
• copy our provider information in bulk, or collect it by automated means, to publish it or to build another database;
• send automated requests beyond normal use, or try to disrupt, overload or break into Banxta;
• present a Banxta result as a provider’s decision or as advice from us;
• use Banxta in any way that breaks the law.

We may block access that breaks these rules.

Intellectual property

The text, design and software of Banxta, and the way we select and organise provider information, belong to us or to the people who license them to us. You may use your results for your own company and share your result link. Please ask us before republishing our content.

Quotes from providers’ pages remain the providers’ words. We show each one with its source and the date we checked it.

Providers’ names and logos belong to the providers. We show a logo only to identify the provider next to its name. No provider has licensed its logo to us or endorsed Banxta. Our statement about the logos, including where the files came from, is at /marks/LICENSE.txt. If you are a provider and want your logo removed, write to info@banxta.app and we will remove it.

Availability

Banxta is a pilot. We may change, pause or stop it, or any part of it, at any time. We do not promise that it will always be available or free of errors.

Liability

Banxta is a free information service, and you use it on your own judgement. To the extent the law allows, we are not liable for any loss that comes from relying on a result or on other information on Banxta, such as a refused application, a closed account, lost profit or lost time.

Nothing in these terms limits liability that the law does not allow to be limited, such as liability for fraud, or for death or personal injury caused by negligence. Nothing in these terms takes away rights you have by law that cannot be given up by agreement.

Other websites

Banxta links to providers’ published pages as sources. We do not control those sites and are not responsible for them.

Changes to these terms

We may update these terms. We will publish the new version on this page with a new date. Changes apply from the date they are published, and if you use Banxta after that, the new terms apply.

Law and courts

These terms, and any dispute about them, are governed by the law of Spain. If you use Banxta as a consumer, this does not take away the protection of the mandatory law of the country where you live, and you may also bring a claim in the courts of that country.
